Terms and Conditions of Sale

Flatpack Cabinet Co Pty Ltd (ACN 699 465 239, ABN 88 699 465 239)
Effective 29 September 2026

Application

1.1 These Terms govern all quotes, orders and sales of custom cabinetry, cut-to-size panels, flatpack components and associated hardware (Products) by Flatpack Cabinet Co Pty Ltd (we, us) to any customer, including trade contractors (you), through our website or associated ordering portals.

1.2 By registering an account, submitting a design or placing an order, you agree to these Terms. If you order for another person, you confirm that you have their authority.

1.3 We may update these Terms. The Terms in force when we accept your order apply to that order.

1.4 In these Terms, ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Consumer means a person who acquires Products as a consumer under the ACL. Business Customer means any other customer.

Online ordering and design software

2.1 Our website includes design software (including GoCabinets and related tools) that lets you design projects, enter measurements, select materials and calculate pricing. The software provider’s own terms may also apply to your use of it.

2.2 We manufacture strictly to the dimensions, tolerances, materials and hardware you enter. We do not measure on site, inspect your site or verify floor plans or the suitability of the Products for your space. You are responsible for checking that your measurements and specifications are correct and suit your site before you submit the order.

2.3 Before you pay, the portal will show a summary of your dimensions and selections. After payment we will email you an order confirmation. You may ask us to correct an error in your specifications until 24 hours after payment or until production starts, whichever is earlier. We will make the correction where we can and may charge for any extra materials.

2.4 We are not liable for loss arising because specifications you entered were inaccurate or did not suit your site. Where panels must be re-cut or replaced for that reason, we will charge our standard production rates.

2.5 Clause 2.4 does not apply to our errors, including a machine fault, a failure to cut to your entered specifications or a misread file. We will re-cut or replace affected parts at our cost, without limiting clause 7.

2.6 We supply Products only and do not install them. You or your installer are responsible for installation, for compliance with building, electrical, plumbing and safety requirements, and for fixing cabinets securely.

Pricing and payment

3.1 Because Products are custom cut, payment of 100% of the order total, including GST, is required when you place the order.

3.2 We do not offer credit accounts. Your order will not enter the production queue, and cutting will not start, until we receive cleared funds in full.

3.3 Prices are in Australian dollars and include GST unless stated otherwise. We will issue a tax invoice.

3.4 A contract is formed only when we send you an order confirmation email. Until then we may decline your order and refund any payment. Quotes are valid for 14 days.

Cancellation and correction

4.1 Before production starts, we may cancel or correct an order if there is a clear pricing error, a software or system fault, unavailability of materials or a material error in your layout that we could not reasonably have identified when we accepted the order.

4.2 If we cancel under clause 4.1, we will refund everything you paid for the order within 5 business days. If we propose to correct a pricing error instead, you may accept the corrected price or cancel and receive a full refund.

4.3 We will not cancel an order or change its price because of a pricing error after production has started.

4.4 Because Products are made to your specifications, you may cancel for change of mind only before production starts, and we may keep a reasonable amount for payment processing costs. After production starts we cannot refund a change of mind.

4.5 This clause does not limit your rights under the ACL.

Lead times and variations

5.1 We estimate about 2 weeks for melamine flatpacks and 4 to 5 weeks for two-pack painted flatpacks, counted from the later of cleared payment and your order confirmation. These are estimates, and we will use reasonable endeavours to meet them.

5.2 We are not liable for delay caused by events beyond our reasonable control, such as material shortages, supply chain disruption, transport delays, power outages or breakdown of properly maintained machinery. We will tell you promptly of any significant delay.

5.3 If the Products are not ready 14 days after the end of the estimated period, and you did not cause the delay, you may cancel the order and we will refund the money paid for Products not yet made available to you.

5.4 Colours, finishes and grain shown on screens, CAD models or render tools may differ from physical items because of monitor calibration, batch variation and natural grain. Minor differences of this kind are not defects. This clause does not apply where the Products materially differ from a sample or description we gave you.

Collection, delivery, risk and title

6.1 For collection from Units 1 & 2, 11–15 Business Drive, Narangba QLD 4504, risk in the Products passes to you when they are loaded onto your or your carrier’s vehicle, except for damage caused by our staff while loading. You are responsible for securing the load.

6.2 Where we deliver, risk passes when the Products are unloaded at the nominated address. You must ensure safe access.

6.3 Ownership passes to you when we have received cleared payment in full and the Products have been collected or delivered.

6.4 Please collect your order within 14 days of our notice that it is ready. After that we may charge reasonable storage costs or deliver at your cost.

6.5 Please inspect the Products on collection or delivery and tell us in writing of missing items or visible defects as soon as possible, and within 7 days. Late notice may make a claim harder to verify, but this clause does not limit your rights under the ACL.

Australian Consumer Law

7.1 Our Products come with guarantees that cannot be excluded under the ACL. If you are a Consumer, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

7.2 Nothing in these Terms excludes, restricts or modifies any right or guarantee that cannot lawfully be excluded. If a clause conflicts with this clause 7, this clause prevails.

Limitation of liability

8.1 If you are a Consumer, nothing in these Terms limits your rights under the ACL.

8.2 If you are a Business Customer, then to the extent permitted by law we exclude all implied conditions and warranties, and our liability for breach of any guarantee or implied term is limited, at our option, to replacing the Products, repairing them or paying the cost of doing either.

8.3 Subject to clauses 7 and 8.1, and to the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of site time arising from the supply, delivery or installation of the Products.

Governing law and complaints

9.1 These Terms are governed by the laws of Queensland, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.

9.2 To make a complaint, contact us at [email protected] or 0420 140 380. We will respond within 5 business days. This does not prevent you from going to a regulator, tribunal or court.

Privacy

We handle personal information in accordance with our Privacy Policy, available on our website.

General

These Terms, your quote and our order confirmation are the whole agreement for the order. If a provision is unenforceable, the rest continues. A failure to enforce a right is not a waiver of it. We may communicate with you electronically.
